1. Introduction

Welcome to Enthelot Studio. These Terms of Service (“Terms”) govern the engagement and delivery of all services between Enthelot Studio (“we”, “us”, or “our”) and you, the client (“you” or “Client”). By engaging with our studio, you acknowledge that you have read, understood, and agreed to be legally bound by these Terms.

Enthelot Studio is a design-led, service-first creative agency offering web design, digital branding, motion graphics, and website maintenance solutions to individuals, startups, and established businesses. We are positioning ourselves as a premium creative partner, and our Terms are designed to reflect the standard of professionalism, accountability, and excellence we deliver.

2. Scope of Services

Enthelot Studio offers a wide range of digital services, including but not limited to:

• Custom Web Design & Development (Static and Dynamic Websites)

• Web Maintenance & Security Services

• Graphic Design Services (Logo design, Branding packages, Marketing Collateral)

• Motion Graphics & Animation (Explainers, Intros, Brand Promos)

• Content Strategy & Design Consultation

• Google Business Profile Setup and Optimization

• Web Hosting services via our dedicated platform: www.enthelot.co.ke (offered under our ownership but managed as a separate hosting division)

All services are scoped and customized based on your needs. Detailed service proposals and scope-of-work documents are shared prior to the start of any engagement.

3. Pricing and Premium Positioning

Enthelot Studio does not compete on price. We are not a low-cost agency, nor do we aim to underbid other freelancers or studios. Our pricing is carefully structured to reflect the strategy, craftsmanship, experience, and reliability built into every project we deliver.

If your main concern is cost over quality, we may not be the right fit for your needs. We are committed to delivering lasting impact and aesthetic excellence — not cutting corners. Our pricing structure is non-negotiable, although we offer scalable packages that allow for phased implementation of services over time.

4. Deposits, Payments, and Billing Terms

A 60% deposit is required to initiate any project. This deposit is non-refundable and secures both our time and resource allocation. The remaining 40% balance is due upon project completion and before final delivery of any watermark-free files or access credentials.

Late payment beyond 7 days after the invoice due date will incur a 30% late payment penalty. We reserve the right to suspend or terminate the project in the event of non-payment.

Clients seeking to upgrade or add new features post-delivery may be subject to an upgrade fee of 20% of the original project cost, depending on the scope of changes.

5. Deliverables and Approvals

All deliverables are submitted with watermarks or in a preview format until the final payment is completed. You will be entitled to up to two rounds of revisions per milestone, unless otherwise agreed in your proposal.

Approvals and communications must be made in writing (email or WhatsApp). Failure to respond within 14 days may result in the project being placed on hold, rescheduled, or terminated without refund.

6. Hosting Services and Third-Party Infrastructure

We offer web hosting through our platform: www.enthelot.co.ke, which is maintained under our ownership and adheres to strict uptime and performance standards.

If a client chooses to use a third-party hosting provider, Enthelot Studio assumes no responsibility for website uptime, performance, security breaches, or server-based functionality issues. Any technical support on such platforms may incur additional hourly charges.

7. File Storage and Retrieval

Final project files are stored securely on our system for future access. Clients who wish to retain access to these files after delivery may subscribe to one of our storage plans:

• 200MB: Ksh 2,000/year

• 500MB: Ksh 3,000/year

• 2GB: Ksh 5,000/year

Clients can access stored deliverables through a secure login portal. If a client loses access and has not subscribed to a storage plan, a file recovery fee may apply.

8. Refund Policy

All payments are final. We do not issue refunds for services once a project has been initiated. In special circumstances, partial refunds or credit for future services may be considered, but this is at the full discretion of Enthelot Studio.

9. Project Termination

We reserve the right to terminate a project at any time due to unprofessional conduct, lack of communication for over 14 days, non-payment, or client breach of these Terms. All deposits paid up to the point of termination will be retained.

10. Performance Disclaimer

Enthelot Studio provides high-performance websites, visual content, and branding tools. However, we are not responsible for your business outcomes. This includes but is not limited to:

• Sales performance

• Customer acquisition or retention

• Negative reviews or customer feedback

For instance, we have encountered clients whose poor service led to negative online reviews. While we built a strong digital presence for them, they blamed us for their brand being “visible in the wrong light.” We do not and cannot control how the public responds to your business performance.

Our duty is to position you with tools to succeed — it is your responsibility to use them well.

11. eCoins and Client Accounts

Clients with official accounts can earn eCoins, which can be redeemed for Enthelot services. These eCoins:

• Have no monetary value

• Are valid for 12 months

• Are not transferrable

We reserve the right to modify, suspend, or terminate the eCoin system at any time.

12. Client Expectations and Suitability

We only engage with serious clients who understand the value of what we offer. If you find our quoted price too high, we recommend starting with a lower-tier package which can be improved later at an additional fee.

We do not lower our prices to match freelancers, other studios or ‘general-market rates’. 

13. Communication & Support

Our team is available via WhatsApp and email. We generally respond within 5 Minutes during weekdays from 3:00Am – 10:00 Pm. Clients under maintenance plans may receive prioritized support.

14. Legal Governance

These Terms are governed by the laws of Kenya. Any legal dispute arising from this agreement will be resolved first through negotiation, then through formal arbitration if necessary.

15. Acceptance of Terms

By paying a deposit or signing a service agreement, you accept and agree to be bound by these Terms. If you are not satisfied with or do not agree to any of the above clauses, we advise that you refrain from engaging with our services.

We take our time, process, and quality seriously — and we expect our clients to do the same.
